General Terms and Conditions of Manuela Hermetter Qualifying People eU

§ 1 Scope
Manuela Hermetter Qualifying People eU (hereafter: Hermetter) organizes seminars and lectures or appears as a lecturer at externally organized seminars. These GTC apply to all contractual relationships between Hermetter and its clients (hereinafter: participants).
§ 2 Conclusion of contract, formation, limited number of participants, withdrawal by Hermetter
A contract is formed upon confirmation of the participant's registration for an event offered by Hermetter. Hermetter reserves the right to reject registrations and to cancel events at short notice (e.g. due to too few or too many participants, illness, for organizational reasons, etc.). In this case, Hermetter will reimburse costs already paid. Any further claims for damages by the participant are excluded.
§ 3 Cancellation, withdrawal by the participant
If a participant does not appear at the event or withdraws from the contract, Hermetter will charge a cancellation fee of 50% of the participation fee up to 3 days before the start of the event, and 100% thereafter. The nomination of a substitute participant by the participant is possible free of charge, the obligation of the participant to pay the participant fee remains unaffected.
§ 4 Warranty
Hermetter does not owe any specific success and assumes no liability for the correctness and usefulness of the seminar content.
§ 5 Liability
Hermetter is not liable for damage suffered by the participant during the seminar, unless the participant proves gross negligence or intent to Hermetter.
§ 6 data protection
The client agrees to the personal use of his data, the checking of his creditworthiness and the receipt of newsletters.
§ 7 Law, Place of Jurisdiction
Austrian law applies. The place of jurisdiction for all disputes between Hermetter and the participant is Klagenfurt, unless otherwise stipulated by the KSchG.
